IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING ZONE ONE
By accessing or using Zone One ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

1. ACCEPTANCE OF TERMS
1.1. Agreement to Terms: By creating an account, accessing, or using Zone One, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
1.2. Eligibility: You must be at least 18 years of age and have the legal capacity to enter into contracts to use this Service. By using the Service, you represent and warrant that you meet these requirements.
1.3. Modifications: Zone One reserves the right to modify these Terms at any time without prior notice. Continued use of the Service after modifications constitutes acceptance of the updated Terms.

2. SERVICE DESCRIPTION AND LIMITATIONS
2.1. What Zone One Does
Zone One is a LinkedIn monitoring and notification tool that:
Tracks specified LinkedIn profiles for new posts
Sends notifications when tracked profiles publish content
Provides a dashboard to view prospect activity
Reminds users to engage with content
2.2. What Zone One Does NOT Do
Zone One does NOT:
Automatically comment, like, or engage on your behalf
Send connection requests automatically
Access your LinkedIn account credentials
Guarantee any specific results, acceptance rates, or outcomes
2.3. Important Service Limitations
CRITICAL FEED SCANNING LIMITATION:
a) 14-Minute Maximum Scan Time: Zone One's automated feed scanning stops after a maximum of 14 minutes per prospect per scan cycle. If a prospect's feed does not yield sufficient post data within this 14-minute window, scanning will cease for that prospect until the next scheduled scan.
b) No Guarantee of Full Package Allocation: You acknowledge and agree that:
The number of prospects you can track (10, 50, or unlimited) is a MAXIMUM limit, not a guarantee
If Zone One cannot locate sufficient posts within the 14-minute scan window, your allocated prospect slots may not be fully utilized
You will NOT receive refunds, credits, or compensation if fewer prospects are effectively tracked due to feed scanning limitations
Factors affecting feed availability include: LinkedIn's feed algorithm, prospect posting frequency, LinkedIn platform restrictions, and API limitations
c) Feed Availability Factors: Post availability depends on factors outside Zone One's control, including but not limited to:
LinkedIn's proprietary feed algorithms
Prospect's posting frequency and activity
LinkedIn platform changes, updates, or restrictions
Network connectivity issues
LinkedIn's rate limiting or access restrictions
2.4. Daily Allocation and Expiration
DAILY LIMITS AND NON-ROLLOVER POLICY:
a) Daily Resets: All package allocations (notifications, tracking slots, engagement reminders) reset daily at 12:00 AM EST.
b) Non-Transferable: Unused allocations from any given day do NOT roll over to subsequent days. If you do not use your daily allocation, it is forfeited and cannot be recovered, transferred, or credited.
c) No Refunds for Unused Allocations: You will NOT receive refunds, credits, or compensation for:
Unused daily allocations
Days you do not access the Service
Notifications you do not act upon
Prospects you do not engage with
d) Package-Specific Daily Limits:
Starter Plan: 3 prospect tracking slots per day (non-rollover)
Professional Plan: 6 prospect tracking slots per day (non-rollover)
Enterprise Plan: 9 tracking slots per day (non-rollover)

3. LINKEDIN PLATFORM RESTRICTIONS
3.1. Prohibited Users
LINKEDIN EMPLOYEES AND AFFILIATES PROHIBITED:
a) The following individuals and entities are EXPRESSLY PROHIBITED from accessing, using, or evaluating Zone One:
Current LinkedIn employees (full-time, part-time, contract, or temporary)
Former LinkedIn employees (within 2 years of separation)
LinkedIn contractors, consultants, or vendors
Microsoft employees with access to LinkedIn operations
Family members of LinkedIn employees (spouse, parent, child, sibling)
Any entity affiliated with, owned by, or controlled by LinkedIn Corporation or Microsoft Corporation
Individuals acting on behalf of LinkedIn for competitive intelligence, legal investigation, or enforcement purposes
b) Verification: Zone One reserves the right to verify user identity and employment status at any time.
c) Immediate Termination: Accounts identified as belonging to prohibited users will be immediately terminated without refund.
d) Legal Consequences: Prohibited users accessing the Service may be subject to legal action for:
Breach of contract
Fraudulent misrepresentation
Unauthorized access to proprietary systems
Violation of trade secret protections
e) Anti-Circumvention: Creating accounts under false pretenses, using false identities, or attempting to circumvent these restrictions is strictly prohibited and may result in civil and criminal penalties.
3.2. LinkedIn Account Risks
NO LIABILITY FOR LINKEDIN ACCOUNT RESTRICTIONS:
a) Account Risk Acknowledgment: You explicitly acknowledge and agree that:
Using third-party tools to monitor LinkedIn may violate LinkedIn's Terms of Service
LinkedIn may flag, restrict, suspend, or permanently ban your account for using Zone One
Zone One has NO control over LinkedIn's enforcement actions
Zone One is NOT responsible for any consequences resulting from LinkedIn's actions against your account
b) Express Disclaimer: ZONE ONE MAKES NO WARRANTIES OR REPRESENTATIONS THAT:
The Service complies with LinkedIn's Terms of Service
Your use of the Service will not result in LinkedIn account restrictions
LinkedIn will not take action against your account
Your LinkedIn account will remain in good standing
c) No Liability for Account Actions: Zone One, its officers, directors, employees, agents, and affiliates shall NOT be liable for:
LinkedIn account suspensions, restrictions, or bans
Loss of LinkedIn connections, data, or content
Damage to professional reputation resulting from LinkedIn account actions
Lost business opportunities due to LinkedIn account restrictions
Any direct, indirect, incidental, consequential, or punitive damages arising from LinkedIn's actions against your account
d) Indemnification: You agree to indemnify and hold harmless Zone One from any claims, damages, losses, or expenses (including attorney's fees) arising from LinkedIn's actions against your account.
e) User Responsibility: YOU are solely responsible for:
Understanding LinkedIn's Terms of Service
Evaluating the risks of using third-party monitoring tools
Deciding whether to use Zone One despite these risks
Any consequences resulting from your use of the Service
3.3. Compliance with LinkedIn Terms
a) User Obligation: You are solely responsible for ensuring your use of Zone One complies with LinkedIn's Terms of Service, User Agreement, and Privacy Policy.
b) No Endorsement: Zone One's operation does not constitute LinkedIn's endorsement, approval, or authorization of the Service.
c) Changes to LinkedIn Platform: LinkedIn may change its platform, policies, or API access at any time, which may affect Zone One's functionality. Zone One is not liable for service disruptions caused by LinkedIn platform changes.

4. USER RESPONSIBILITIES AND PROHIBITED CONDUCT
4.1. Acceptable Use
You agree to use Zone One only for:
Legitimate professional networking purposes
Building genuine business relationships
Ethical engagement with LinkedIn content
Lawful purposes in compliance with all applicable laws
4.2. Prohibited Activities
You shall NOT:
a) Automation Violations:
Use Zone One in conjunction with automation tools, bots, or scripts
Attempt to automate engagement, comments, or connection requests
Use the Service to spam, harass, or send unsolicited messages
b) System Abuse:
Attempt to circumvent the 14-minute scan limitation
Manipulate, hack, or reverse-engineer the Service
Access the Service through unauthorized means
Share account credentials with others
Create multiple accounts to circumvent package limitations
c) Data Misuse:
Scrape, harvest, or collect data from the Service for unauthorized purposes
Sell, transfer, or distribute data obtained through the Service
Use data for purposes other than personal professional networking
d) Harmful Conduct:
Engage in fraudulent, deceptive, or misleading practices
Violate any person's privacy or intellectual property rights
Use the Service to defame, abuse, harass, or threaten others
Transmit viruses, malware, or harmful code
e) LinkedIn Platform Violations:
Use the Service in any manner that violates LinkedIn's Terms of Service
Engage in activity that could lead to LinkedIn account restrictions
4.3. Consequences of Violations
Violation of these Terms may result in:
Immediate account suspension or termination without refund
Legal action to recover damages
Reporting to law enforcement authorities
Permanent ban from the Service

5. SUBSCRIPTION, BILLING, AND PAYMENTS
5.1. Subscription Plans
a) Available Plans:
Starter: $49/month - 3 prospect tracking slots (daily reset, non-rollover)
Professional: $99/month - 6 prospect tracking slots (daily reset, non-rollover)
Enterprise: $249/month - 9 prospect tracking slots (daily reset, non-rollover)
b) Plan Selection: You select your subscription plan during registration. Plans may be changed in accordance with Section 5.7.
5.2. Billing Cycle
a) Recurring Billing: All subscriptions are billed on a recurring monthly or annual basis, depending on the billing frequency you select.
b) Billing Date: You will be charged on the date you subscribe and on the same date each subsequent billing period.
c) Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date.
5.3. Payment Methods
a) Accepted Payments: We accept credit cards, debit cards, and other payment methods as displayed during checkout.
b) Payment Authorization: By providing payment information, you authorize Zone One to charge your payment method for all fees incurred.
c) Payment Processing: Payments are processed by third-party payment processors. Zone One does not store your full payment card details.
d) Failed Payments: If payment fails:
You will be notified via email
You have 7 days to update payment information
After 7 days, your account may be suspended or terminated
You remain liable for all unpaid fees
5.4. Pricing Changes
a) Right to Modify: Zone One reserves the right to change subscription prices at any time.
b) Notice: You will receive at least 30 days' notice of price increases.
c) Acceptance: Continued use after price changes constitutes acceptance of new pricing.
d) Grandfathering: Existing subscribers may be grandfathered at current pricing for a limited time at Zone One's sole discretion.
5.5. Taxes
a) User Responsibility: You are responsible for all applicable taxes (sales tax, VAT, GST, etc.) associated with your subscription.
b) Tax Collection: Zone One may collect applicable taxes if required by law.
c) Tax Exemption: If you claim tax exemption, you must provide valid documentation.
5.6. Refund Policy
NO REFUNDS POLICY:
a) No Refunds: ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE, including but not limited to:
Monthly or annual subscription fees
Unused portions of subscription periods
Unused daily allocations
Services not utilized
Account suspensions or terminations (with or without cause)
Service disruptions, downtime, or technical issues
Dissatisfaction with the Service
LinkedIn account restrictions or bans
Failure to achieve desired results
b) No Pro-Rata Refunds: If you cancel mid-billing cycle, you will NOT receive a pro-rata refund for the unused portion.
c) Service Credits: Zone One may, at its sole discretion, issue service credits for extended outages, but is under no obligation to do so.
d) Exceptions: Refunds may only be issued if required by applicable law or in Zone One's sole discretion on a case-by-case basis.
5.7. Plan Changes and Downgrades
a) Upgrades: You may upgrade your plan at any time. Upgrades take effect immediately, and you will be charged the pro-rated difference.
b) Downgrades: You may downgrade your plan at any time. Downgrades take effect at the start of the next billing cycle.
c) No Refunds for Downgrades: Downgrading does not entitle you to a refund for the current billing period.
5.8. Cancellation
a) User-Initiated Cancellation: You may cancel your subscription at any time through your account settings.
b) Effect of Cancellation: Upon cancellation:
Your subscription remains active until the end of the current billing period
You will not be charged for subsequent billing periods
You lose access to the Service at the end of the billing period
No refunds will be issued for the current billing period
c) Company-Initiated Termination: Zone One may terminate your account immediately for violations of these Terms, non-payment, or at its sole discretion.

6. INTELLECTUAL PROPERTY
6.1. Zone One Ownership
a) Proprietary Rights: Zone One owns all rights, title, and interest in:
The Service platform, software, and code
All content, graphics, user interfaces, and designs
Trademarks, service marks, logos, and brand elements
Proprietary algorithms, methodologies, and processes
All improvements, updates, and derivative works
b) License Grant: Subject to these Terms, Zone One grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal professional use.
c) Restrictions: You may NOT:
Copy, modify, or create derivative works of the Service
Reverse engineer, decompile, or disassemble the Service
Remove or alter any proprietary notices
Use the Service to build a competitive product
License, sell, rent, lease, or otherwise commercialize the Service
6.2. User Content
a) User Data: You retain ownership of data you input into the Service (prospect names, notes, etc.).
b) License to Zone One: By using the Service, you grant Zone One a worldwide, royalty-free license to use, store, and process your data solely to provide the Service.
c) Aggregated Data: Zone One may use anonymized, aggregated data for analytics, improvement, and research purposes.
6.3. Feedback
Any feedback, suggestions, or ideas you provide to Zone One become the property of Zone One, and Zone One may use them without restriction or compensation.

7. PRIVACY AND DATA PROTECTION
7.1. Data Collection
Zone One collects:
Account information (name, email, payment details)
LinkedIn profile data you authorize us to track
Usage data (login times, features used, etc.)
Technical data (IP address, browser type, etc.)
7.2. Data Use
We use your data to:
Provide and improve the Service
Send notifications and communications
Process payments
Comply with legal obligations
7.3. Data Security
a) Security Measures: Zone One implements industry-standard security measures to protect your data.
b) No Guarantee: However, NO method of transmission or storage is 100% secure. Zone One CANNOT guarantee absolute security.
c) Breach Notification: In the event of a data breach, Zone One will notify affected users in accordance with applicable law.
7.4. Data Retention
a) Active Accounts: Data is retained while your account is active.
b) After Termination: Data may be retained for up to 90 days after account termination, then deleted unless required by law.
c) Backup Retention: Data in backups may persist longer but will not be used except for disaster recovery.
7.5. Privacy Policy
For more information, see our Privacy Policy at [privacy policy URL]. The Privacy Policy is incorporated by reference into these Terms.

8. DISCLAIMERS AND WARRANTIES
8.1. "AS IS" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY
UNINTERRUPTED OR ERROR-FREE OPERATION
8.2. No Guarantees
ZONE ONE MAKES NO WARRANTIES OR REPRESENTATIONS THAT:
The Service will meet your requirements or expectations
The Service will achieve any specific results (connection acceptance rates, engagement levels, etc.)
The Service will operate without interruption, delays, or errors
Defects will be corrected
The Service is free from viruses or harmful components
Your LinkedIn account will not be restricted or banned
Tracked prospects will post content within the 14-minute scan window
Daily allocations will be fully utilized
8.3. Third-Party Services
Zone One relies on third-party services (LinkedIn's platform, payment processors, hosting providers). Zone One is NOT responsible for failures, interruptions, or issues caused by third parties.
8.4. Results Disclaimer
ZONE ONE DOES NOT GUARANTEE:
Any specific number of connections accepted
Any specific engagement levels
Any specific business outcomes or revenue
That prospects will engage with your comments
That you will achieve professional success through the Service

9. LIMITATION OF LIABILITY
9.1. Maximum Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZONE ONE'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO ZONE ONE IN THE 12 MONTHS PRECEDING THE CLAIM.
9.2. Excluded Damages
IN NO EVENT SHALL ZONE ONE BE LIABLE FOR:
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
LOSS OF GOODWILL OR REPUTATION
COST OF SUBSTITUTE SERVICES
DAMAGES RESULTING FROM:
LinkedIn account restrictions, suspensions, or bans
Inability to use the Service
Unauthorized access to your account
Service interruptions or errors
Third-party actions (including LinkedIn)
Your reliance on the Service
Failure to achieve desired results
9.3. Basis of the Bargain
You acknowledge that Zone One has set its prices and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, and that the same form an essential basis of the bargain between the parties.

10. INDEMNIFICATION
10.1. Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless Zone One, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
a) Your violation of these Terms b) Your use or misuse of the Service c) Your violation of any rights of another party, including LinkedIn d) Your violation of any applicable law or regulation e) LinkedIn's actions against your account (restriction, suspension, ban) f) Any content or data you submit through the Service g) Your failure to comply with LinkedIn's Terms of Service
10.2. Defense of Claims
Zone One reserves the right to assume exclusive defense and control of any matter subject to indemnification, in which case you will cooperate with Zone One in asserting any available defenses.

11. DISPUTE RESOLUTION
11.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [YOUR JURISDICTION], without regard to conflict of law principles.
11.2. Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY:
a) Agreement to Arbitrate: You and Zone One agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration, rather than in court, except as provided below.
b) Arbitration Rules: Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
c) Location: Arbitration will take place in [YOUR CITY, STATE].
d) Costs: Each party shall bear its own costs, unless the arbitrator awards costs to the prevailing party.
e) No Class Actions: YOU AGREE THAT DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.
f) Exceptions: Either party may seek injunctive or equitable relief in court to protect intellectual property rights.
11.3. Informal Resolution
Before initiating arbitration, you agree to first contact Zone One to attempt to resolve the dispute informally by emailing legal@zoneone.com.
11.4. Waiver of Jury Trial
TO THE EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

12. GENERAL PROVISIONS
12.1. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Zone One regarding the Service and supersede all prior agreements.
12.2. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.3. Waiver
Zone One's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
12.4. Assignment
a) Zone One's Rights: Zone One may assign these Terms or any rights hereunder without your consent.
b) Your Restrictions: You may NOT assign these Terms or any rights hereunder without Zone One's prior written consent.
12.5. Force Majeure
Zone One shall not be liable for any delay or failure to perform due to causes beyond its reasonable control, including acts of God, war, terrorism, labor disputes, internet failures, or governmental actions.
12.6. Notices
a) To You: Zone One may provide notices to you via email to the address associated with your account.
b) To Zone One: You may provide notices to legal@zoneone.com.
12.7. Export Compliance
You may not use the Service if you are prohibited from receiving U.S. exports under U.S. law.
12.8. Survival
Sections that by their nature should survive termination shall survive, including: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.
